FHFA claims not exercising executive powers of the President but they are using Presidential privilege for blocking the documents in the Sweeney case

FHFA contends that even if it acted as the government when it imposed the Net Worth Sweep, it was not exercising “the type of executive powers that demand Presidential supervision.” FHFA Reply 4.
