A complete wrap up of Oil States with breakdown of what the writer sees from each Judge. No way its unanimous either way. But more reading material on the case. It appears it will come down to Thomas, Alito and Kennedy.

Gorsuch and Roberts for getting rid,
Ginsburg and Sotomayor keeping. Probably Kagan and Breyer as well.
So it will come down to what Alito, Thomas and kennedy do.
I think in my opinion it will be a 5-4 decision, and total toss up between which way.


Based on what I’m hearing following Monday’s arguments in Oil States v. Greene’s Energy, a lot of lawyers are reading the clues differently. Savvy lawyers are predicting everything from a unanimous affirmance keeping IPRs in place to a lopsided reversal declaring them unconstitutional.

Some people—maybe including me—are going to be surprised when this opinion comes down. But here’s my take.
