I told you they were probably getting in the weeds on things that didn't matter. All they had to do was write yes or no for literal infringement or doctrine of equivalents. Their jury instructions said nothing about the legal ramifications of the previous case. That was for judges to decide and not jurors.

We'll see next Monday if there is any attempt to clean it up a bit. I would declare a mistrial and a tainted jury that did not follow instructions and do the whole thing from scratch.
