This is clearly not a "reasonable" jury and they need to be dismissed. I can live with a directed verdict from Judge Freeman even if it means no willful infringement.
This would work (but will never happen). Judge Freeman rules infringement in BC II. BC I gets remanded for damages only. BC I and BC II are combined into one trial for damages determination only. That would be an elegant solution.
I'm anxious for them to file the minutes and any jury notes from Friday. Haven't seen them yet.
