@muff, there are two schools of NOLs. The most popular and the most likely to happen is 51% goes to old equity. The other option is under an exception, they can discharge equity and give the entire stake to guaranteed/reaffirmed creditors like CTs. The people I know who are in the NOL camp are betting on the 51% to equity. A few of them know more and are more experienced than me so, I agree ;). If you hold commons, I think you will get a share of the NOLs. The safest bet is still the CTs. CTs win no matter what route as long as there is a route because of the guarantee, parity and non discharge clauses which are all confirmed valid in this BK by Peck.
If Cottonisking is right, and CTs get paid earlier, then class 12 might make out big by not having the CTs and class 10 on top of them. I believe class 11 is discharagable. JMHO.
