Definitely unanimous needed. Also, the bar is only proof "by a preponderance of the evidence" and not "beyond a reasonable doubt". Jury instructions use the language "more likely than not" most of the time which will make the finding of infringement easy. It is the amount and whether or not to call it willful that is contested.
