So the fact you mention the words/phrase prohibited and not per se illegal in a single same paragraph is not only contextually misleading but also doesn't equate to:

"[naked shorting is] prohibited but not illegal" as you wrote.

Naked shorting is strictly permissible given only very specific market making and broker agency limitations. And it's time limited.

Abusive naked shorting, that is, without locating or reserving shares within certain limits (thus naked) by either brokers or their clients is blatantly illegal. This, the situation we've been referring to all along when we speak about Curaegis.

I'm very familiar with the specific passage you quoted off the SEC website. BTW, you and I have been through this same discussion before. More than once. And the same explanation has always applied.
