No, you are assuming that American Green can obtain 500 signatures from registered voters out of the 2 million in San Bernardino County because you ASSUME that San Bernardino County falls under the "affected area" when it comes to incorporating Nipton, which it DOES NOT.

You assumed wrong. The commission has already provided clarification on this:

"But state incorporation guidelines require would-be towns to prove the viability of their tax bases. Nipton, with fewer than 20 residents, "would not come close," Wert said."

“State law requires a minimum of 500 registered voters and a minimum population of 10,000 residents in order to have a tax base to offset the costs of basic municipal needs such as law enforcement,” she said. “So due diligence appears to be a little short in this case.”

They don't have the population to support the tax base, they don't have the required number of registered voters living in the affected area, Nipton can not incorporate.
