So you are saying that Berge files 10Qs with a full financial statement and doesn't show "Convertible Notes" as a liability on his balance sheet? I have checked and his balance sheets have all balanced as expected. So have his cash flow statements.

I think you meant to claim he doesn't disclose them for a up to as much as 3 months but as we agree, there is nothing wrong nor illegal about that.
