Well, I've said for years now that SCOTUS was inevitable. That it wasn't "if" we file with SCOTUS, it was just a matter of "when". Granted, it took a lot longer than I thought...but...
And I'll make another statement with SCOTUS. Let's not forget that this is a filing that is solely about the ability to judicially bar the case at hand. So, it will not rule on the ability to judicially bar unrelated cases AND it does not rule on the merits of the case. I will say what I said before...it is inevitable that BOTH of these issues will end up in SCOTUS.
