I'm not a legal advisor but why in the world would we expect the clean slated company that's merging in to pay legal fees? That's a profitable outfit that doesn't need that baggage they could take their business elsewhere...

And IF we're suggesting that shareholders are footing the bill then I'd argue that explains why the pps is where it's at....the legal dispute isn't a new thing the risk/draw backs have already been priced in imo. In fact this is probably OVERsold as the market has this priced like an unfathomable scenario is gonna unfold where as I think any scenario that unfolds will allow for stress free upward movement
