The other salient point you raise is that GERS is a "public company". Now I am purely speculating here, but what if KK took GERS private tomorrow and paid the common shareholders a nickel a share? That would cost him $1,000,000 but allow him to do what he wanted with the settlement proceeds (after paying off C&C, YAGI and other debt holders) without any public scrutiny. That might fit his long-term strategy well.
