You have to sign for certified mail I believe, that's why it's called "Certified" so that the sender who is paying for the certification get's a signed receipt from the receiver.

Unless he disregarded the notice or didn't receive any, then his claim would hold true.
But then the mail would have been returned to sender "Undeliverable" or still waiting to be received.
