--In June, U.S. District Judge Sue L. Robinson increased a jury's $3 million damages award and roundly rejected Apple’s attempts to overturn the verdict that the iPhone 3G and 4 had infringed the ‘231 patent, according to court documents.
Judge Robinson tripled the award to $9 million — the bare minimum damages calculation of 12.5 cents per offending iPhone — after Apple failed to present its own damages expert at trial. She also awarded Ironworks approximately $1.75 million in interest.
“Plaintiff came forward with reliable and sufficient evidence of damages in the range between 12.5 cents and 83 cents [per unit],” Judge Robinson wrote. “Therefore, the burden shifted to defendant to present an alternative damages figure.” ---
