Thank you for your explanation of an "open patent." Unfortunately, I don't understand.

In the first post, you said:

Assuming the patent in question is still enforceable, i.e., it is valid and maintenance fees are up to date, the patent is not "free to anyone." Rather, it belongs to the assignee, or if no assignee, to the inventors. The patent holder has the right to exclude others from using it. No one is "free" to use it without permission of the patent holder.
