Of course the verdict will survive. I never said it wouldn't. I said it looks like a good possibility is a remand for a new trial ON DAMAGES and not to retry the merits.

Hopefully the judges have enough info to reduce the amount to a proper level and be done with it, but I don't think they do. Original Blue Coat attorneys were horrible. They (rightfully) disagreed with how the amount was calculated at post-trial motion hearing, but never presented what it should have been so it is not in the record.
