At THAT point, the litigation is "closed."
There have been several "closings"...the "closing" of the Stalking Horse Auction, the closing of the asset sale agreement, the "closing" of the petition by Soupman, Inc. to have WC prove they had enough shares, etc.
We don't know to-which-closing the paragraph was referring when it stated that there must be a PR release within 10-business-days after the "closing."
