thanks for your DD on the range for damages. the wild card, as i see it, is share structure. MAXD is also litigating over short selling of their stock, and if it can be proven their OS increased by X amount due to manipulation of the pps, then some or all of those shares could be litigated and returned/cancelled.

a favorable judgement on the patent infringement for $100M on an OS of 1.4B is one thing, but on an OS of (hypothetically) 400M would be another ball game. certainly a win for shareholders, either way, but i like the odds for an adjustment to capital structure.
