Even if it is, 1) they can't afford the appeal since they have no money. 2) since they weren't even able to come up with the cost of goods sold for the original lawsuit, they really have no standing for an appeal. They're going to lose. 3) Even if they win, they'd still be out 2/3 of the $2.4 million, which is the approximate gross profit, so in the end there is little difference.
