Indeed. But what I find interesting is that Etrade has seemingly checked out of the case. The last time Etrade filed anything was on May 3rd, when Matthew Reilly filed a joint brief on behalf of the 4 brokerage defendants opposing COR's motion to compel discovery responses.

Since then we have heard from NFS once, on July 14th, and numerous times from Scottrade/Ameritrade as well as SST and COR. Just seems odd that 2 brokers would repeatedly contest elements of the case and 2 others would not.
