Sheriff Arpaio was denied the right to a jury trial despite begging the US Supreme Court.

U.S. District Court Judge Susan Bolton denied Arpaio the right to a jury trial in the case earlier this month. The U.S. Ninth Circuit Court of Appeals upheld her ruling last week.

Arpaio could have appealed on the basis of not being allowed a jury trial. A jury trial is the foundation to our democracy. Further, the judge was biased and should have recused herself. She had denied his request for a jury trial. This is odd since it was a criminal charge.

Arizona has a large number of illegal immigrants. They commit crimes at a higher rate than the general public. For example, in 2007, illegal immigrants made up nine percent of the adult population in Maricopa County. Yet they received 20 percent of all felony DUIs.

They are more likely to commit traffic infractions. A large number of them have not learned U.S. traffic laws. They have less money, so are more likely to have something wrong with their cars. This prompts the police to pull them over.

Judge Snow refused to consider these facts. Instead, he chose to believe instead that the men and women of the Maricopa County Sheriff’s Office — many who are Hispanic and other minorities — pull drivers over because they are targeting illegal immigrants.
