Some great backup info on a PTAB hearing in Apr 2017:

The Patent Trial and Appeal Board on Tuesday upheld a patent for a secure communications system that was challenged in inter partes reviews by companies including Amazon.com Inc. and IBM Corp., potentially clearing the way for a pair of infringement lawsuits to move forward.

Amazon and the others argued that several claims in the patent, which belongs to ZitoVault LLC, were invalid because they were either anticipated or obvious. But the PTAB said in a final decision that they had not convincingly shown that to be the case.

“We conclude that petitioner has not met its burden to show, by a preponderance of the evidence, that [the challenged claims] are unpatentable,” the board wrote.

The patent covers a system that provides a way to maintain a number of cryptographic sessions.

ZitoVault, a software company based in Carlsbad, California, filed separate lawsuits against Amazon and IBM in the Eastern District of Texas in 2015. It said some of their respective cloud computing services, like IBM Cloud and Amazon Web Services, infringed the patent.
