Might be, but it also weakens the position of the others IMO. Don't forget this lawsuit is only against a few of the infringers. Yes, it would be better if all settle, especially the big ones, but if it comes to the chance of there being no settlement or a partial settlement, I would say it's more likely that some might settle instead of none. But it depends on how much GERS is asking, and how sure the defendants are the appeal gives them a better chance.
Can they risk the outcome?
Regarding my previous posts, I think that C&C isn't looking for a very long negotiation period on the settlement. However, the longer it takes, the higher their aim is I think, or they are pretty sure the settlement is going to happen for all.
