The proof of fraud is that they presented financial information to the government that allowed their proposal evaluation to score them good enough. At that same time, IMSC officials were aware of the shakey debt situation that made them go bankrupt shortly thereafter. On the verge of bankruptcy would not score them good enough under any accounting guidlines. So much for full disclosure.
