Wow... that is a very basic thing. Cases get thrown out all the time because they weren't filed in a timely manner once the infringement was known or SHOULD have been known.

I don't believe I have seen a single set of affirmative defenses by a Finjan defendant where they did NOT raise this issue. So far, Finjan has skated saying there were "active negotiations" for years, but I still contend that someone is going to tell the judge, "We told them years ago we disagreed we were infringing and refused a license" and the judge will throw the case out.
