You are correct. Additionally, the IRS has very specific rules on employee and independent contractor status and it is extremely difficult to classify an employee as both an emoloyee sometimes and an independent. The services they provide the company would have to be vastly different than the services they provide as an employee. I can't really see much of a difference in the services these guys are providing as consultants vs what they should be providing as employees. Also, wages over $127,000 arent subject to employee or employer social security taxes. There is no cap on medicare taxes but that's only 1.45% so that's not really an incentive. It costs more to have an accountant do your corporate tax return than it would be to just pay the medicare tax. The tax argument is weak imo.
