Everyone puts their bitcoins in a wallet. Every bitcoin held in a wallet has the security key and can convert after the fork into either currency . All the major US Bitcoin exchanges also supported the hard fork. You are saying if CCTL's bitcoins were not held in a wallet like everyone else and were held in one of the few smaller exchanges that didnt support the fork that everyone knew was coming, then what you lay out might happen. Ok sure lol.
