So what? Get a lawyer make a class action case for corporate malfesience and negligent faduciary behavior.

See how far you get. These guys are good and that's not a worry at all. The only chance would be nailing Seymour for all the private side emails, but likely the recipients wouldn't participate. At least not until the bankruptcy.
