I wouldn't be surprised if an offer is countered and accepted. Knowing the disdain Berman has for shareholders this would solve many problems. He most likely would attach to the new company.

If there is a big chance of a large settlement the last thing Berman would want is for that money to stay in a public company. Any significant assets like a settlement would force DECN to be a reporting SEC company again.
