Some thoughts from a patent attorney I know who is also an investor in BPTH:

"I do find it a little disturbing that they are reporting this so quickly. Most the time you want to wait until the patent actually issues to start gloating about it because there is the possibility that a competitor could contact the Examiner and point out art that was missed, and the Examiner can withdraw the Notice of Allowance. It is very rare, but I’ve seen it happen. That said, I guess there is a possibility that the firm they are working with has never seen it happen so they told them to go ahead and go public with it. The reason I think it’s sad that they felt the need to jump on it so quickly is that it’s an indicator that they have no other news to report so they are jumping as quickly as possible on anything they can."
