That's not quite what happened. The Herpicide trademark that died wasn't owned by NanoViricides.

Long story, short version:
Some company registered it in 1949 and transferred it in '76. It was allowed to expire in '92.

In '83 a different company TRIED to register it but failed to respond to a USPTO Office Action (I didn't look but I'll bet the USPTO probably wanted to know why they thought that they could register an EXISTING trademark.) and it went POOF!








I was given that information....I don't know.
