A Shell can't be back flipped into by another scam, if the underlying company of the stock doesn't have a business license in a State. That problem has been solved. The state of Nevada could care less about whether the stock associated with a business is a Shell or otherwise.

Neither has the SEC at the speed of a turtle ever dislisted this delinquent scam - even though all conditions have been met for delisting. A Shell or any other form of stock can not be reinstated by the SEC if it has never been delisted. Actually, we should change speed from turtle to snail.
