"The Notice also states that the Capital Preferreds may
have a Claim for a dividend by LBHI - see 5.7.5. "

The POR states there will be no share distribution while still in BK.

Also, LBHI will take a discharge and CTs are non dischargable plus CTs are quasi debt/equity as well.

You put those two together, we are in pretty good shape.
