Document Requests
In accordance with the foregoing Definitions and Instructions, please produce the following Documents:
Document Request No. 1. All Documents, Communications and Financial Analyses Concerning any Valuation of the Debtors.
Document Request No. 2. All Documents, Communications and Financial Analyses Concerning the Debtors’ “mark-to-market” or “fair value” accounting practices or methodologies, including Valuation Materials and working papers leading to published balance sheet values for property, plant, and equipment for the Form 10-Q and Form 10-K disclosures for the years 2015, 2016, and 2017 (year-to-date).
Document Request No. 3. All Business Reports, Financial Statements, and Financial Analyses Concerning the Debtors, including without limitation all Documents that support the value of the Debtors’ oil and natural gas properties as reflected in their consolidated balance sheets for 2015, 2016 and the first quarter of 2017.
Document Request No. 4. All Documents, Communications and Financial Analyses Concerning the Solvency of the Debtors at any time.
Document Request No. 5. All Documents, Communications and Financial Analyses Concerning any Opinion Concerning the Solvency of the Debtors at any time.
Document Request No. 6. All Documents, Communications and Financial Analyses Concerning any Valuation of the Debtors’ assets.
Document Request No. 7. All Documents, Communications and Financial Analyses made available to the Debtors Concerning the assessments prepared by the Carnrite Group, LLC Concerning the Debtors’ organization, general and administrative costs, or cost competitiveness.
Document Request No. 8. All Documents, Communications and Financial Analyses Concerning the Valuation of the Debtors’ property located in the Permian Basin.
Document Request No. 9. All Documents, Communications and Financial Analyses Concerning the market for property located in the Permian Basin, including the analysis and screening assumptions used by the Debtors’ management and advisors to reject said bids, proposals, or expressions of interest.
Document Request No. 10. All Documents, Communications and Financial Analyses Concerning any offers, bids, proposals or expressions of interest in purchasing or otherwise acquiring any of the property of the Debtors or interests in property of the Debtors located in the Permian Basin, California, Ark-La-Tex, Midwest, Rockies, Florida, and Postle.
Document Request No. 11. All Documents, Communications and Financial Analyses Concerning the Valuation of the reorganized Debtors.
Document Request No. 12. All Documents, Communications, Opinions and Financial Analyses Concerning the market price of oil used in any Valuation, including the commodity price decks used by the Debtors for investment, acquisition, and divesture screening and decision making.
Document Request No. 13. All Documents, Communications and Financial Analyses Concerning the Board’s decision to pay dividends to holders of the Debtors’ common units in 2015 and to holders of its preferred units in 2015 and 2016 and Concerning the Board’s decision to stop paying such dividends.
Document Request No. 14. All independent auditor letters, deficiency reports, and other Communications to the Debtors or their management Concerning the Debtors’ status as a going concern, the Debtors’ Solvency, or the carried values of assets on the Debtors’ balance sheet for each quarter and year from 2015 to and including 2017 (year-to-date).
Document Request No. 15. All Communications, including discussions and negotiations, between the Debtors and third parties relating to Document Requests 1-14.
Document Request No. 16. All Documents and Financial Analyses provided by the Debtors to third parties relating to Document Requests 1-14.
