You are incorrect. If Nanologix has its USA patent then it has the only rights to sell that technology in the USA. It would not have the rights to sell in China or the EU, and conversely those with the rights elsewhere would not legally be able to sell against the issued USA patent. That's basic international patent law. Look it up.
