Oil States Energy Services, LLC is going to argue before the Supreme Court that, under the Constitution, only federal courts can rule a patent invalid and not executive Tribunals like the patent trial and appeal board. If the Supreme Court rules in favor of OCES, then all patents that were deemed invalid by the PTAB, can be resurrected to life.
