"ORDER granting in part and denying in part75 Motion to Dismiss. For the reasons described above, Defendants' motion to dismiss is GRANTED in part and DENIED in part. ECF No. 75. Specifically, Plaintiffs' third cause of action is DISMISSED. Defendants' motion to dismiss Plaintiffs' claims for the appointment of a receiver and injunctive relief is denied. Plaintiffs are ordered to amend the Amended Complaint to clarify their grounds for seeking the punitive damages and identify the exact allegations they believe give rise to the claim. SO ORDERED. Then on 4/26 the plaintiffs filed for reconsideration of the parts that were dismissed.
Now Arrayit yesterday filed against reconsideration.
It's up to the judge to decide about the reconsideration. Then after that I suppose they will go to trial with whatever claims remain in the case.
