IMO it would be too late to appeal and obviously the FDA would have been just to rescind SPA. (IF R-I "failed")

The more I think about Amarin appealing SPA the less enthused I am the FDA will reverse anything until R-I is finished. In this case I don't think a suit against Amarin would fly.

If R-I is a success and the FDA delays an expanded label and the stock does nothing...I think Amarin is vulnerable for not fully appealing SPA.

If Amarin was going to launch a new appeal off court win, we should hear about it by Monday; I'm guessing they won't.
