Once we communicated with the Federal Circuit Clerk of Court and verified that the filing required if mediation/settlement discussions were not fruitful had NOT been filed by May 20, this was the final fact required for us to place our bet on the pass line. There are many other facts pointing to successful resolution via settlement or the appeal that have been itemized in previous posts. But resolution via adjudication of the appeal would have taken much longer and with the settlement apparently at hand, now was the time to place (increase) our bet.

Should the mediation prove unsuccessful, the parties will submit a briefing schedule for the Court’s approval by May 19, 2017.

We are hopeful that we have enticed journalists covering this industry to delve into this "scoop". The facts are in evidence and we have pointed them toward these sources. The initiation of the ligation was big news in this industry years ago -- its apparent closure would be very newsworthy. Such publicity would help get the PPS moving north.
