I think I see where you're going -- they can't seek damages for a destroyed business if business is thriving. But I guess I don't see why visiting NAB matters. Lots of failed businesses visit NAB.

Also, the amended complaint has nothing to do with the appeal. Dimension is appealing the low award of costs and the denial of fees. They aren't appealing the various losses on the damages claims.
