Do I think there is a case to be made to reopen the BK plan? Yes. But it is not that it will be overturned and adjusted down the road that is the primary threat. It is the simple fact that the potential delays involved could cost ATT and the FCC far more than the spectrum is worth. If the transaction price is $2B and someone gets a court to reopen the BK plan and it causes any remand to the licenses then that ultimately could cost ATT $20B+ in lost time and revenue opportunity...probably much much more. Also the FCC under Trump want's Jobs, Jobs, Jobs, and having this spectrum on the sideline would inhibit job growth.
