Apparently they have already been to trial once, as the article you referenced states: " They were also found guilty of operating video gaming machines."

It also appears that they couldn't stay away from it: "Both men were also charge in December last year for allegedly operating a store that sold electronic sweepstakes."

It seems as if the December charges are the second set against him. If that is the case, I would bet that the judge will not be very friendly.
