"This matter has been litigated since 2015. Originally, the lawsuit was filed in South Florida and then transferred to the present court. The Plaintiff has been openly engaged in discovery since the inception of the lawsuit in the Southern District of Florida, and has received documents and taken various depositions, including a 30(b)(6) deposition. The Plaintiff has also set further depositions at the end of April which will, most likely, be the last non-expert depositions needed by the Plaintiff. To date, the Defendants have not taken the depositions of any of the Plaintiff’s fact witnesses nor a 30(b)(6) deposition and none have been set by the Defendants.
The pleadings in this matter have closed, with the Defendants having filed an Answer with Affirmative Defenses.1 As such, the matter is ripe to be set for trial.
As such, and for the above stated reasons, the Plaintiff prays for an order setting the matter for trial on the Court’s trial docket."
