Why is the company being not aware of the litigation considered a fact?

Because they claim it?

That's the sketchy part. No one has proven this as I can see.

And if it is true, does it really matter?

Seems to me that getting this off the books is paramount, not a belief in the Doc with the really fly hat.

Is there some kind of paperwork we haven't seen filed with the court asking for relief?
