STATUS REPORT
The parties hereby jointly submit a status report pursuant to this Court’s March 3,
2017 Order (D.I. 106) that stayed this action pending the U.S. Patent Trial and Appeal
Board’s (“PTAB”) decision whether to institute recently filed petitions for inter parties
review of the three patents-in-suit (the “Cisco IPR petitions”). The PTAB has issued its
decisions. Of the three patents-in-suit, the PTAB denied review of two (the 8,341,679 and
8,984,565 patents), and granted review of one (the 7,941,822 patent). The PTAB had
previously instituted an IPR against the asserted claims of the ’822 patent last year (on a
petition filed by RPX) (the “RPX IPR”).
As a result:
(i) No IPRs and no IPR petitions are pending against any claim of the ’679 and
’565 patents (constituting 22 of the 30 asserted claims); and
(ii) Multiple IPRs are pending against the ’822 patent (covering all asserted claims
of the ‘822 patent, constituting 8 of the 30 asserted claims).
Also pursuant to the Court’s March 3, 2017 Order (D.I. 106), the parties have
attached copies of the PTAB’s decisions regarding the Cisco IPR petitions.
