The FDA never would have allowed a GMO containing a human gene to be let loose in the market without prior clinical trials to establish safety. Witness the noise around GMO crops.
The hook for the MNZO scam was the patent angle. Microcrap "investors" really like patents! I'm following a scam which is too patent funny. After spending years pumping their patent, they gave it away for free to their Pres with no compensation. As a registered stock, didn't bother to file a 8K as a material event. SEC didn't care.
My read was that Kenny would import some bulk lactobacilli from China, bottle it in the US, and presto another supplement on the market. The FDA wouldn't care. Kenny could claim whatever he wanted as a supplement. Maybe the FTC would look into false advertising claims- maybe not. The SEC wouldn't have cared what a pinky said. No doubt Kenny would've been pumping that he was selling thousands of bottles on Amazon. A pinky can say anything. Just so long as they don't perform an illegal stock dump.
Biotechs are a good scam angle for scammers. Supplements are even better. Since outside of GMOs, there's no requirement for FDA approval. No way to track a time line like a drug approval.
