The fact that a judge is ex IBM could be more of a problem than a help. Given that the bulk of the patents revolve around software engineering structures poorly understood by the patent office then a software savey person could well see through them. All the fuss about 2D and 3D avatars is simple testimony to a general ignorance of how software is designed in the first place.
