Its really simple. Here's an example. If, Edison had filed a patent application to patent the light bulb on 01 January 1925 then someone had filed an application for the exact same thing one month later on 01 February 1925, the application that was filed first gets precedence in deciding who to grant the patent to.

So, the next thing that they look at in deciding whether to grant a patent, is - are there any other similar applications for this process/technology that we have already granted application for?

Is the patent maybe too similar to another existing patent already granted? If it was, the applications would have been rejected.

So when deciding whether to grant the patents or not, when they look at each one they will examine whether whatever process is discussed in the application is so unique that nobody has patented it before.

That's why. for example, serial inventors, regularly file patent applications for their inventions.

I honestly believe the sub lingual tablet should have applications far above and beyond marijuana only.

Don't forget TEVA just wanted 1) An official licence to use their patents and 2) Wanted that fact kept secret.

So please also remember, once an application is filed that is a public document as others can read it and challenge the patent application and say we already invented this like ten years ago.

So, TEVA had a good look at OWCP's patent applications and thought they were so amazing they wanted to use them, but didn't want anyone to know that.

To me that seems very misleading of TEVA. They seemed to want free use of all OWCP's patents yet not tell anyone including the market that that's how they developed their possible new product line?

TEVA's already viewed those patent applications and thinks they're that amazing they wanted to use the technology.

What more can we say - the reasons above are why you file a patent application - to protect your intellectual property rights!

The final thing to remember is that they grant the patent to the first person/company that files the application.

OWCP is ahead of the curve and had the sense to protect its intellectual property the right way.
