I believe you need to be careful how the legal action proceeds if you intend to sue him. As ceo he gets to use idle media funds to defend himself and if forced into bk could sell it off and wipe out shareholders.
Might be better to go to the NASDAQ/SEc to have them push him into doing what he said he would do, save a lot of money on attorney fees.
