I had posted previously regarding Otiko's new patent application to protect the IP from the abandonded patents (I believe it was waterpro42 that posted that).
As I said then, it seems like an uphill battle to get a new patent on art/invention that has previously been filed on. Even if those previous applications are abandoned or expired, they still constitute an existing description of the art. If the processor of the patent considers them too similar they could refuse the patent.
We know the delivery method is not mechanical, it is part of the ointment I believe. Therefore the ingredients (solvents, encapsulators, etc) used as part of the penetrating solution should be in the ointment. Based on that I compared the ingredients lists of Tetrastem/Diabecline/Viabecline to see if there were any differences. I used the DailyMed site so that I had consistent comparison.
TetraStem and Diabecline are pretty much identical. Viabecline on the other hand does have some different ingredients(highlighted), I am no chemist so not know whether these differences would materially distinguish the delivery method:
